  • Construction Services with Reverse Charge

    As of 1 January 2017 the act of 1 December 2016 on the amendment of the goods and services tax act and certain other laws, providing for, among others, the application of reverse charge mechanism to a significant part of construction works conducted by subcontractors, entered into force.
  • Investments in Transmission Infrastructure – Attempts to Streamline Processes

    Over recent years, there have been a few attempts to introduce legal solutions aiming to quicken investments related to transmission infrastructure. And so, on July 24 2015, a so-called special transmission act was passed, i.e. a law on preparation and execution of strategic investments in the area of transmission networks. After a year and a half, there are good reasons to take a closer look at the act proposed by the legislator and the role it was supposed to serve in practice, as well as other similar regulations related to transmission networks.
  • Facilitations for Entrepreneurs - Changes to Regulations

    The first of the planned changes to regulations aiming to facilitate entrepreneurs' business operation entered into force as of January 1 2017. Some of the most important changes introduced with the act of December 16 2016 on changes to certain acts in order to improve entrepreneurs' legal environment are those concerning the Commercial Companies Code and the commercial power of attorney specified in the Civil Code.
  • A package of solutions tightening VAT comes into force on January 1 2017

    On November 17 this year, the act amending the value added tax act and other acts, aiming to tighten the tax system in the area of VAT collection, was conveyed to the President and the Speaker of the Senate. The majority of the changes planned are to enter into force as soon as on January 1 2017.
  • Changes to registration for VAT as from January 2017

    A law whose purpose is, first and foremost, to improve VAT collection ratio is currently at an advanced stage of the legislation process. Additionally, it aims to verify the list of entities registered as active VAT payers. The draft act is a harbinger of several changes to the rules of registration as a VAT payer, as well as signing off. Presented below are some of the changes regulating this aspect of business operation.
  • “SRWN” - a new type of company dedicated to investors from the commercial real estate market

    As follows, regarding the revenues mentioned above, the effective corporate income tax will not be 19%, as it is now, but 0% (tax exemption from CIT). In this way, taxation will take place only on the stage of net profit distribution of the srwn, in the form of dividends paid to shareholders (as a rule flat-rate is 19%).
